The EB-5 Program Has Several Key Properties And Features:
Investment Requirement
EB-5 investors are required to invest a minimum amount of capital into a qualifying commercial enterprise in the United States. The minimum investment amount varies depending on whether the investment is made in a Targeted Employment Area (TEA) or a non-TEA. As of my last update, the minimum investment amount was $1.8 million for non-TEA investments and $900,000 for investments in TEAs, which are areas with high unemployment rates or rural areas.
Removal of Conditions
To transition from conditional permanent residency to unconditional permanent residency, EB-5 investors must file a petition to remove the conditions on their residency within the 90-day period before the two-year anniversary of their admission to the United States as conditional permanent residents. This petition must demonstrate that the required investment was made and that the requisite jobs were created or will be created within a reasonable time.
Job Creation Requirement
One of the primary objectives of the EB-5 program is to create jobs for U.S. workers. Investors must demonstrate that their investment has created or will create at least 10 full-time jobs for qualifying U.S. workers within two years of their admission to the United States as conditional permanent residents.
Regional Centers
Many EB-5 investors choose to invest through USCIS-designated EB-5 Regional Centers, which are private entities that facilitate EB-5 investments in specific projects. Regional Centers can offer investors a more passive investment opportunity and often pool investments from multiple EB-5 investors to fund larger projects.
Conditional Permanent Residence
Successful EB-5 applicants and their eligible family members are granted conditional permanent residency status in the United States for a period of two years. During this conditional period, they have most of the same rights and privileges as other lawful permanent residents, including the ability to live and work in the United States.
Path to Citizenship
Successfully obtaining unconditional permanent residency through the EB-5 program can eventually lead to U.S. citizenship for investors and their families. After maintaining permanent residency status for a certain period of time, typically five years, investors may be eligible to apply for naturalization and become U.S. citizens, subject to meeting additional requirements.
